Terms of Use

If you had an account before this date, anything here that gives you more rights applies to you at once, and the rest 30 days after this date.

These terms are the agreement between you and us for using Fersonal.

1. Who we are

Fersonal is run by PROGRAMERSKE STORITVE, Primož Pesjak s.p., Lipje 4A, 3320 Velenje, Slovenia ("we"). Email: [email protected]. These terms cover the Fersonal app and the website fersonal.app.

2. Who can use Fersonal

  • You must be 18 or older.
  • Fersonal is made for healthy adults. It is not made for people who are injured, recovering from an injury or operation, pregnant, or living with a condition that makes exercise risky, unless a doctor has said this kind of training is safe for them.
  • You agree to these terms when you create an account.

3. Your account

  • You sign in with your email address. Anyone who can read that email can sign in, so keep it safe.
  • Give correct details, especially your birth date, height and weight. Your workouts are planned from them.
  • An account is for one person.

4. What Fersonal does, and what it does not do

  • Fersonal plans strength and muscle-building workouts from your goal, equipment, schedule, check-ins and recent training, and lets you log what you did.
  • Some of what Fersonal shows you is made with AI (OpenAI), such as workout notes and the summary after a workout. AI can be wrong. If something looks off, trust your own judgement.
  • Fersonal does not watch you train or check your form. It gives general training suggestions. It is not medical advice and not a medical device.

5. Health and safety

  • Check with a doctor before you start if you have a health condition, have had an injury, are pregnant, or have not exercised for a long time.
  • Warm up, use equipment you know how to use safely, and train within your limits.
  • Stop at once if you feel pain, dizziness, shortness of breath, chest pain, numbness or tingling, and get medical help if it does not pass.
  • The weights and reps we suggest are a starting point. You decide what you lift.

6. Fersonal Premium

  • Some features need Fersonal Premium, a subscription. It is sold through the App Store or Google Play, which handle payment, renewals, cancellations and refunds under their own terms.
  • The store shows the price, the billing period and any free trial before you buy.
  • Premium renews automatically until you cancel it in your App Store or Google Play settings. You keep it until the end of the period you paid for. Deleting your account or the app does not cancel your subscription.
  • If the price goes up, the store tells you first and, where its rules require, asks you to accept the new price.
  • In the EU and the UK you can usually withdraw from a purchase within 14 days, through the store: reportaproblem.apple.com or the Google Play withdrawal form.

7. Changes

  • We may change Fersonal for a good reason, such as keeping it working, safe and up to date, or improving how workouts are planned. You may need to update the app to keep using it.
  • We may change these terms when the law, the stores' rules or Fersonal change. We do not change the essential parts of our agreement without your agreement. We tell you about other changes that matter to you by email or in the app 30 days before they apply. If you do not agree, you can cancel your subscription and delete your account before then.

8. Using Fersonal fairly

Do not misuse Fersonal, try to break or overload it, get into accounts or data that are not yours, scrape it with automated tools, or copy its content (exercise videos, instructions, texts) outside the app. If someone does this seriously or repeatedly, we can suspend or close their account. We tell them why first, unless the law or safety requires us to act at once.

9. Our rights

Fersonal, its design, texts, exercise instructions and videos belong to us or to the people who license them to us. You may use Fersonal for your own personal training.

10. Our responsibility

  • If Fersonal does not work as described, you have the rights the law gives you. Tell us at [email protected].
  • Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for harm caused on purpose or by gross negligence, or any other liability that the law does not allow us to limit or exclude.
  • We are not responsible for losses we could not reasonably foresee, or for problems caused by things outside our control, such as your internet connection, your phone, or a store being unavailable.

11. Complaints and disputes

  • Complaints. Email [email protected].
  • Out-of-court dispute resolution. We do not recognise any provider of out-of-court consumer dispute resolution as competent for disputes with us.
  • Law. Slovenian law applies to these terms. If you are a consumer, you also keep the protection of the mandatory rules of the country where you live.

12. Apple and Google

These terms are between you and us, not Apple or Google. If you got Fersonal from the App Store, Apple's Licensed Application End User License Agreement also applies to your licence for the app.
